Welcome to Zimyo, your trusted partner in human resources management. Your access to and use of our software signifies your agreement to abide by these Terms. We encourage you to review them carefully. 

By accessing or using our software, you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, please refrain from using our services. 

Your use of Zimyo signifies your acceptance of these Terms and your commitment to working with us to streamline and enhance your HR processes. 

Acceptance of Terms 

By accessing or using the Zimyo software (“Service”), you agree to comply with and be bound by these Terms of Service. If you disagree with these Terms, please do not use the Service. 

Description of Service 

Zimyo is a cloud-based human resources management software designed for businesses. The Service may include HR-related features such as: 

  • Attendance and time tracking 
  • Onboarding and offboarding 
  • Employee data management 
  • Recruitment management 
  • Payroll processing 
  • Reporting and analytics tools 
  • Performance management 
  • Other HR automation features 

The features available may vary depending on the subscription plan. 

Account Registration 

To access the Service, you must create a Zimyo account. You are responsible for: 

  • Maintaining the confidentiality of your account credentials 
  • Restricting access to your account 
  • All activities that occur under your account 

 

Zimyo will not be liable for any loss or damage arising from your failure to protect your account credentials. 

Intellectual Property 

All rights, title, and interest in and to the Service, including software, technology, trademarks, logos, and content, remain the exclusive property of Zimyo. 

The customer is granted a limited, non-exclusive, non-transferable license to use the Service during the subscription term. 

The customer shall not: 

  • Copy, modify, or distribute the Service 
  • Reverse engineer or attempt to extract source code 
  • Use the Service to build a competing product 
Payment and Subscription 

Certain features of the Service require payment of subscription fees. 

  • Subscription fees and billing terms will be specified in a separate agreement or order form. 
  • All fees are exclusive of applicable taxes unless stated otherwise. 
  • We may offer free trials for a limited period. 
  • Fees are non-refundable unless expressly agreed in writing. 
  • Failure to pay applicable fees may result in suspension or termination of access to the Service. 
Privacy and Data Security 

By using the Service, you agree to Zimyo’s Privacy Policy. Zimyo prioritizes data security and privacy and implements reasonable technical and organizational safeguards to protect customer data. Customers are responsible for: 

  • Ensuring they have obtained necessary employee consents 
  • Complying with applicable data protection and employment laws 
  • Ensuring the accuracy of the data entered into the system 
User Responsibilities 

Compliance: You agree to use the Service in compliance with all applicable laws and regulations. 

Content: You are solely responsible for the content you upload, post, or share through the Service. You agree not to upload or share any content that is: 

  • Unlawful 
  • Harmful or abusive 
  • Infringing on intellectual property rights 
  • In violation of privacy rights 
Termination 

The customer may terminate the Service in accordance with the applicable subscription agreement. Upon termination: 

  • Access to the account may be disabled. 
  • Customer data may be retained for a limited period thirty (30) days following termination to allow data retrieval. 
  • After such period, data may be permanently deleted, unless otherwise required by law. 

Zimyo reserves the right to suspend or terminate the Service in the event of material non-compliance with these Terms. Where applicable, reasonable notice will be provided. 

Changes to Terms 

Zimyo may update these Terms from time to time. Any changes will be effective upon posting on our website. Continued use of the Service after such changes indicates your acceptance of the revised Terms. 

Responsibility Disclaimer 

Zimyo is committed to providing a reliable and secure HR management platform. However, Zimyo is not responsible for:

  • Errors resulting from incorrect data entry

  • Misconfiguration of payroll or compliance settings

  • Misuse of the system by users

While we provide training materials and support to assist our customers, users remain responsible for how they configure and use the system.

Service Availability 

While Zimyo strives to maintain uninterrupted access to the Service, availability may be affected by maintenance, system upgrades, or technical issues. Zimyo does not guarantee uninterrupted or error-free operation. 

Limitation of Liability 

To the maximum extent permitted by applicable law, Zimyo shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Service. Zimyo’s total liability shall not exceed the subscription fees paid by the customer in the preceding twelve (12) months. 

Governing Law 

These Terms shall be governed by the laws specified in the applicable agreement between the parties. Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction or dispute resolution mechanism agreed between the parties in the applicable agreement.
